I have agreed to participate in VeloVirtual indoor cycling sessions. I acknowledge that there are risks involved in participating in this session. I am fully aware that the session, in which I agree to participate, is of a nature that is strenuous and may push me to the limits of my physical abilities.

I understand that my participation in this activity involves potential risk of injury, including but not limited to bodily injury, heart attack, stroke, or even death. I also recognise there are other risks associated with exercise and that it is not possible to list everyone. I know and understand the risks of exercise, understand that injuries are a possibility, and I hereby assume all risks of injury which could occur by reason of my participation in this fitness class. I hereby state that I am in good health and am able to take part in this activity. I take full responsibility for my own health and well-being and agree that any instructions received will be used at my own risk.

If I have an existing medical condition and/or have a condition that can be affected by flashing lights and/or loud music I will get medical permission to exercise before partaking in any session at VeloVirtual.

I agree that I am voluntarily participating in these activities and the use of VeloVirtual’s facilities and premises and assume all risks of injury, illness, or death.

This waiver and release of liability includes, without limitation, all injuries which may occur as a result of:

– Use of all amenities and equipment in the facility and participation in any activity, session, program, personal training or instruction

– The sudden and unforeseen malfunctioning of any equipment

– Our instruction, training, supervision, or dietary recommendations 

– Your slipping and/or falling while in the building, or on the premises, including adjacent footpaths, parking areas and nearby public areas.

I acknowledge that I have carefully read this waiver and fully understand that it is a release of liability. I expressly agree to release and discharge VeloVirtual and all affiliates, employees, agents, representatives, successors, or assigns, from any and all claims or causes of action and I agree to voluntarily give up or waive any right that I may otherwise have to bring a legal action against VeloVirtual for personal injury or property damage.

To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence on the part of the facility, its agents, and employees. If any portion of this release from liability shall be deemed by a court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect, and only the offending provision or provisions shall be severed.

I agree that VeloVirtual are not responsible for any loss of my personal property.

I agree to allow VeloVirtual, its employees and volunteers to use picture(s), film and/or likenesses of me for advertising purposes including website, instagram, promotional materials or any other media now known or to be invented. In the event I choose not to allow use of such media I must inform VeloVirtual of this in writing.
